If the forms W-9 and W-8IMY do not expire (although for the W-8IMY the accompanied withholding statement will need to be updated as changes occur to or when the underlying withholding certificates expire) why do the W-8BEN and BEN-E’s? Does the IRS not trust foreign beneficial owners to update the forms? If that is the case then why would the IRS trust them to update the requester within 30 days if there is a “change in circumstance”? I ask again, why do these certificates have an expiration date? I honestly have no clue, but I do know that it creates an onus on the requester to keep track of the expiration date’s data field and to collect new / updated certificates when the “old” ones expire. Unfortunately, the certificate is not a carton of milk that you can toss in the trash and go to the local super market to buy a new one -(. Why on earth do these certificates need an expiration date? Is it going to get moldy in your shared drive? Will it turn to vinegar on your secure cloud file sharing platform? The answer is NO. In this post I will cover the nightmare of expiration dates of certain IRS withholding certificates. Specifically the W-8BEN and W-8BEN-E.
